AccessLex Institute® ("AccessLex") is a nonprofit member organization underpinned by nearly 200 American Bar Association-approved nonprofit and state-affiliated law schools. AccessLex is intently dedicated to fostering broad-based access to quality US-based legal education and works to maximize the value and affordability of a US-based law degree through policy advocacy, research, and student-centered initiatives. Through Helix Bar Review by AccessLexSM ("Helix")—a supporting nonprofit organization of AccessLex—AccessLex is offering a superior bar examination preparation program that applies its resources, relationships and reputation to this critical final step of the law school journey. AccessLex and Helix, along with their respective affiliates and subsidiaries, are collectively referred to in this Privacy Policy as the "Company".
The Company values your privacy and is committed to maintaining the security and confidentiality of your information. In particular, we do not sell your personal information to make a profit. Our primary goals in collecting personal information are to optimize your online experience and advance the Company's nonprofit, student-centered mission (the “Mission”). Any marketing initiatives that we may conduct occasionally, either by ourselves or in concert with our business partners, are solely to promote and facilitate the Company's Mission.
Information That We Collect – Information You Provide
The Company collects personal information about you when you provide it through this website and related pages (the "Site"). Personal information is any information about an individual from which that individual can be identified. Your name, address, phone number, and location are examples of personal data. We collect personal information when you interact with the Site and complete online forms, fields or surveys, create an account, or use the learning management software or tools offered through this Site. Personal information also includes information about your engagement with the Site and your progress towards completion of the bar preparation course materials. We also collect personal information about you if you contact us.
If you register for access to the learning management tools offered through this Site, you will be required to provide your name, address, and email address. You may be asked to provide your telephone number, nickname or social media handle, information about your employment and education, and your Bar Exam score, if applicable. The Company may also endeavor to obtain your Bar Exam score or related academic information from public sources, or, if permitted and appropriate, from your educational institution. Additionally, you may be able to upload certain limited content to the Site, such as comments, notes, feedback, photos, or completed assignments. If you provide us with this type of personal information through this Site, we will collect it and use it as outlined in this Privacy Policy.
Additionally, you may be asked to provide payment information to process your purchase of access to the Program (as defined in the Terms of Use) or certain Program materials. Payment information will not be used for any purpose other than to process your payment (including relevant fraud-protection measures).
Finally, if you stop by a Company booth or table at your school or at a related organization, during an event or otherwise, you may be asked if the Company representative can take your photo, either by yourself or as part of a group. By agreeing to pose for the photo, you permit the Company to use the photo, including your likeness, for limited promotional purposes, such as social media postings. However, under no circumstances will your photo or likeness be sold to any other party.
How We Use Your Information
Consistent with our Mission, the Company, along with our business partners and affiliates, will use your personal information for the primary purpose of advancing cost-effective access to legal education and helping to improve bar passage rates. We also will use your information to improve your experience using this Site.
Additionally, your personal information may be used by the Company in the following ways:
- Conducting general day-to-day business activities;
- Developing and marketing new products or services;
- Communicating with you (including communications from our business partners and affiliates) about the Company's products and services, or about products and services that may be of interest to you, consistent with the Company's Mission;
- Responding to your inquiries or requests, or communicating with you about your Site account;
- Sharing your personal data, or Site and/or Program usage data, with various law schools, law professors, or consultants or other third parties working on the Company’s behalf, as part of initiatives to promote the Company’s nonprofit Mission;
- Monitoring compliance with and enforcing the Site's Terms of Use, and otherwise protecting the safety of Site users and the integrity of the Site;
- Preventing fraud or potentially illegal activities (such as copyright infringement);
- Providing Site technical support or similar assistance; and
- Aggregating information about you, and others like you, to utilize for analysis, research and similar purposes, consistent with the Company's Mission.
It is possible that the Company's corporate structure might change, or that portions of our nonprofit business might be acquired by another entity. In such transactions, customer information generally is a shared and transferred business asset.
By providing your personal information to us, you authorize the Company and its business partners to contact you, including through the use of automated technology. If we receive a Court Order or a subpoena for your personal information, we will disclose it as required by law. We may disclose your personal information as otherwise required by other legal mandates, or for the prevention or detection of a crime. We also may share your information with third parties that you have specifically designated as authorized to receive information from us. If you purchase access to the Helix bar preparation learning tools available through https://success.helixbarreview.org/ (the “Helix Learning Site”), in your capacity as a student of an educational institution with which the Company has a business relationship, the Company may provide your personal information to that institution unless you opt-out of this practice in accordance with instructions specified below. Finally, we may anonymize your information for research and analytical purposes, in which case the information will cease to be personal. We may share anonymized information with third parties for research purposes.
We do not disclose your personal information for profit to anyone. Similarly, we do not host third-party advertising on the Site. However, we may work with third-party vendors that may show you ads for Company products when you are browsing the internet. If you do not want your information to be used as described herein, you should not use this Site. Additionally, in light of the US-based focus of our Mission, if you are a resident of Canada or the European Union, you should not use this Site or provide any personal information through this Site.
Opting-Out of Information Sharing
You have the right, at any time, to opt-out of receiving marketing communications from the Company and its business partners. Specifically, if you receive a marketing email from the Company or its affiliate or business partner, follow the "unsubscribe" instructions provided in the e-mail. If you sign up to receive text messages from the Company but no longer wish to receive them, follow the unsubscribe instructions in the text messages, or text "STOP" in response to such texts.
Additionally, if you prefer that the Company not share information about your engagement with the bar preparation materials on the Helix Learning Site with your educational institution, please email us at [email protected], and include your full name, email address, and the name of your educational institution.

Additional Information – Hosted Website
The bar preparation course materials on the Helix Learning Site are hosted by Watermelon Express, Inc., d/b/a BenchPrep ("BenchPrep"). BenchPrep is a learning management software provider operating at the direction of the Company. Because of this, BenchPrep will not sell or share your information with anyone, except as required by law or as needed to provide services to the Company. Similarly, BenchPrep will not send you any marketing materials. BenchPrep will collect your information to ensure the security of the Helix Learning Site, and to otherwise host and optimize it.
Web Providers; Website Usage Information; IP Addresses, Cookies and Metadata
The Company offers certain other programs and services through third party website or app providers, website operators, and website service providers (collectively “Web Providers”), which host or otherwise operationalize the Company’s online content and/or log-in experience.
While the Company makes reasonable efforts to minimize data collection by and through these Website Providers, the Company does not exercise control over the privacy practices of these entities in every instance. Because of this, the Company encourages you to review the privacy policies of each of these vendors for additional information regarding how your personal information may be collected and used by them. These vendors include, but are not limited to Google, Big Commerce and Qualtrics.
As with many other websites, the Web Providers used to operate the Site may collect certain data pertaining to you and the equipment and communications methods that you use to access the internet and the Site. The Company (along with Web Providers) may also collect general Site usage information, including, but not limited to IP addresses (or similar identifiers) of the devices used to access the Site, or geotracking information about your location. Generally, such information is used for Site maintenance and security. However, some website services like Google’s “captcha” service, impose their own privacy practices, and we encourage you to review them.
The Company or its Web Providers may also use "cookies" or other similar technologies when you visit the Site. Cookies are data files stored on your computer or device for a variety of reasons, including to track information about you, such as when you are logged on to the Site or to identify your preferences. Where possible, you may have the option to set cookie preferences. Otherwise, by using the Site, you consent to the use of cookies and similar tracking methods. At this time, the Site does not recognize automated browser signals regarding tracking mechanisms, which may include "do not track" instructions.
In addition, the Company (including its Web Providers) may retain the content of, and the metadata regarding, any correspondence you may exchange with us, regardless of the mode of communication by which such correspondence was made. This information helps us to improve the Site and the online media, content, materials, opportunities, and services that we feature or describe on the Site, and to more effectively and efficiently respond to both current and future inquiries.
Your continued access to and use of the Site represents your consent to the provisions of this Privacy Policy, and to the provisions of the privacy policies of each respective Web Provider, to the extent applicable.

The Site may contain links to third party websites as a convenience, or to provide you with additional information and functionality, such as payment processing options, which the Company does not manage directly. Finally, the Company does not represent or promise that third party sites accessed through hyperlinks on this Site are free of viruses, worms, Trojan Horses or other code with destructive properties.

Please read these terms of use ("Terms of Use") carefully. These Terms of Use include important disclosures and information regarding your use of this website, related pages and mobile applications (collectively herein, the "Site"), and any portion thereof, and the bar preparation products, components, services, programs or any printed or tangible materials or learning content relating, prepared, produced or published, in whole or in part, by or for Helix (collectively herein, the "Materials").
The Site and the Materials will be collectively referred to herein as the "Program". Your access to or use of the Program is expressly conditioned on your agreement to abide by these Terms of Use and by the terms in the Site Privacy Policy (the "Privacy Policy"). These Terms of Use along with the Privacy Policy constitute the entire agreement between you and the Company concerning your access to and use of the Program.
CONTINUING USE OF THE PROGRAM ACTS AS YOUR CONSENT
By using the Program, you acknowledge that you have read and understand these Terms of Use and the Site's Privacy Policy, and you confirm your unconditional acceptance of same, including all updates and amendments. If you do not agree to abide by the Privacy Policy or these Terms of Use, please do not continue using the Program.
Failure to comply with these Terms of Use and/or the Site Privacy Policy may, among other things, result in the immediate termination of your access to and use of the Program or any portion thereof, at the Company's sole discretion.
Access, Use and your Warranties and Representations
By using or accessing the Program, or any part thereof, you represent, warrant and agree that:
- All information that you provide to the Company in connection with your access to and use of the Program is true, accurate and complete to the best of your knowledge, ability and belief;
- You are a resident of the United States, 18 years of age or older;
- You are using the Program solely for personal, non-commercial use, and specifically to prepare for a bar exam, MPRE, or law school exam;
- You will not share, transfer or disseminate any portion of the Materials available through the Program for any purpose that is inconsistent with these Terms of Use;
- You are not using the Program, or any portion thereof, for the benefit of, or at the direction of, a Company competitor;
- You are not using the Program for any unlawful purpose;
- You will comply with the User Code of Conduct set out in these Terms of Use;
- You will not use any robot, spider, scraper or any other automatic or computer-generated device or manual process to monitor or copy the Program, or any portion thereof, without the Company's express written permission;
- You will not use any device, software or routine to interfere or attempt to interfere with the proper working of the Program or any transaction being conducted on the Site or otherwise through the Program or any part thereof;
- You will not take any action to (i) reverse engineer, decompile, or disassemble any content on the Site or that is otherwise available in connection with the Program; (ii) make any attempt to circumvent the technological measure(s) that controls access to or use of the Site content; (iii) store, cache, use, upload, distribute, or sublicense the Program Content; or (iv) publish or in any other way publicly communicate the results of benchmark tests run on beta or staging environments of the Site (or some other part of the Program) without the prior written permission of the Company.
User Content and Additional Warranties by You
Any content that you may submit or upload through the Site, such as personal information, comments, notes or photos ("User Content"), may be used by the Company in accordance with the Privacy Policy as defined herein. By submitting User Content via this Site, you grant the Company and the Site's host an irrevocable, royalty-free, perpetual, transferable, license to use, modify, create derivative works from, publish, display and sublicense User Content, in whole or in part, in any format and on any platform either now known or hereinafter invented, and to associate User Content with your name and/or likeness.
You are solely responsible for your User Content. You represent that you have the right to submit User Content to us and the right to grant us the license described above. You warrant that User Content, and our use thereof, does not and will not infringe any patent, trademark, trade secret, copyright, or other intellectual or proprietary or privacy right of any party or individual. You further represent and warrant that you will not share any User Content that is lewd, inappropriate, defamatory, disparaging, inappropriate, discriminatory, obscene, offensive, or grossly disrespectful of others.
License Grant by the Company
When you register for an account to obtain full access to the learning tools available through the Program ("Learning Content"), the Company grants you a non-transferable license to access and use this Learning Content solely for your personal, non-commercial use, and solely in connection with your preparation to sit for a Bar Examination. You may not transmit, copy, display, or otherwise relate any portion of the Learning Content to any other individual, group or company. By using the Program, you are acquiring no other right to use artwork, designs, trade secrets, trade names, copyrighted materials, trademarks, or service marks of the Company or any of its affiliates, business partners, or agents.
Termination of Company's License
The license granted to you herein will terminate automatically in the event that the Company, in its sole discretion, determines that you are in violation of these Terms of Use, or any portion thereof, or at the conclusion of your license period. You may terminate or cancel the license granted to you herein by discontinuing use of the Program. In the event of such termination, you agree to promptly delete and destroy all copies of any portion of the Learning Content that you may have previously copied, downloaded or printed or otherwise converted. Such termination will not relieve you of your continuing obligations as set out in these Terms of Use. No refunds will be issued in the event of such a termination or cancelation of the license.
Username and Password
Once you register for an account to obtain full access to the Learning Content available through the Program, you will need to create a username and password to access the Learning Content. This may be a multi-step process with several sets of username and password credentials, and/or security questions. You may not share your username and password with anyone, for any reason, with the exception of sharing these credentials with Company employees or representatives in connection with your request for Program assistance or Site technical support. Additionally, you are responsible for maintaining adequate security measures to ensure that your password and username are kept confidential, and for ensuring that your actions or inactions do not result in a third party's unauthorized access to the Program or any portion thereof. If, at any time, you learn or suspect that your username and password have been disclosed or otherwise made known to any person other than yourself, you agree to immediately (1) change your password to prevent further unauthorized access to your account; and (2) notify the Company of any breach of security relating to your use of the Program by emailing us at [email protected].
Additionally, you agree that the Company will not be responsible for any damages, whether direct, indirect, incidental, consequential, special, exemplary, punitive or other damages, arising out of, resulting from or relating to any use of your password by a third party, whether authorized or unauthorized.
Payment Information; Fraudulent or Unauthorized Activity
If you make a payment using this Site, the Company will not have access to and will not collect your financial information. Rather, this information will be routed to a secure third-party payment processing vendor. The vendor may choose to vault certain payment information to allow for recurring payment transactions, in which case the information will be encrypted and otherwise secured.
By providing a credit card or other payment method to complete the purchase, you authorize the Company (including any third party payment processors) to charge the payment method for the corresponding order amount. You also represent and warrant that you are authorized to use the designated payment method and that you authorize the Company (including any third party payment processors) to charge your payment method for the total amount of your order, including any applicable shipping, handling, taxes or related charges as may be applicable. If the payment method cannot be verified, is invalid or is otherwise not acceptable, your order may be declined or cancelled.
As part of order processing, the Company (or its third party payment processors or other, related service providers) may review the transaction for potential fraud or other types of unauthorized or illegal activity. The Company reserves the right to refuse to process an order due to suspected fraud or other suspected unauthorized or illegal activity. The Company or its duly authorized agents in this regard may also contact you to verify an order or as part of order review. The Company reserves the right to cancel orders and/or account sign-ups, or refuse to ship Materials to certain addresses due to suspected fraud or suspected unauthorized or illegal activity.
Program Changes
The Company reserves the right and may update, revise, and modify the Program from time-to-time and without notice, subject to such changes not materially degrading the Program or your ability to use it. In the unlikely event of a legal error in the materials, the error on the Site will be corrected upon discovery; other Program materials will be updated upon the next scheduled reprint date. Certain Program content is licensed from third parties or reprinted based on Fair Use or public domain principles. The Company expressly disclaims any knowledge and makes no warranties or representations with regard to the accuracy, timeliness or completeness of such third party content.
User Code of Conduct
The Company may remove you from the Site and limit or bar your access to the Program if the Company, in its sole discretion, determines that:
- Your actions are disruptive to the learning environment or dangerous to others;
- You have acted in a manner that shows lack of dignity and respect for others.
- You have violated any intellectual property rights of the Company or other third parties;
- You have engaged in misconduct such as cheating, violating others' confidentiality, or violating these Terms of Use.
- Users removed from the Program for violations of the User Code of Conduct are not eligible for refunds.
Use of Artificial Intelligence Platforms – PROHIBITED
No part of the Program or Program Content may be uploaded to, or otherwise shared by you with any generative artificial intelligence platforms or providers, such as ChatGPT.
Taxes
Your purchase of the Program may be subject to taxes in many states. Tax rates are different from state to state. You are responsible for paying all such taxes.
Sneak Peek
The Company may offer a free preview of the Program. Only one free preview is permitted per person. You may not create additional accounts (such as through the use of pseudonyms and alternate email accounts) for purposes of claiming additional free previews. The Company reserves the right to terminate services to anyone who violates this provision.
Refunds and Cancelations
Books and other non-electronic Program components purchased from the Company, such as Flashcard Sets, are non-refundable for any reason, at any time.
Prior to the start of the online access period, you may cancel your Helix Bar Review enrollment for any reason and receive a full refund, minus a $150 cancellation fee. No refunds will be issued after the start of the online access period.
If a third party (Bill My Employer, etc.) made payment for your course, that third party is entitled to any refund issued.

Helix Bar Success Payment – February and July 2024 Bar Exams
The Company is offering a $200 payment (“Bar Success Payment”), subject to the terms and conditions herein, to any bar exam taker who purchases from the Company a Helix UBESM, Helix CaliforniaSM, or Helix FloridaSM bar review course (each, a “Comprehensive Course”) and passes the applicable bar exam.
This offer is subject to change without notice.
To be eligible for a Bar Success Payment:
- The claimant must:
- Purchase a Comprehensive Course between August 1, 2023 and November 30, 2023 or February 13, 2024 and March 31, 2024, for use in either the February 2024 or July 2024 bar exam administration;
- Pass the specific bar exam for which the Comprehensive Course was purchased;
- Submit required information in a complete and timely manner as described below; and,
- Cooperate with the Company’s reasonable communication efforts to verify eligibility for a Bar Success Payment or otherwise administer this program, and
- The claimant may not, subsequent to the purchase of a Comprehensive Course, take any action to cancel, reverse, or otherwise seek a refund of such purchase.
To claim a Bar Success Payment:
- The claimant must email the following information to [email protected], with “HELIX BAR PASSAGE BONUS CLAIM” in the Subject Line of the email:
- Claimant’s name, state of residence, and email address for confirmation of course purchase and receipt of the Bar Success Payment; and,
- Proof of 2024 bar exam passage, such as copy of official notification or record from the relevant state authorities, by:
- June 14, 2024 (for February bar examination takers), and
- December 13, 2024 (for July bar examination takers).
The Company reserves the right to verify all submitted information, and any submission that is found to be false or incomplete, in the Company’s sole discretion, will be disqualified. The Company may also communicate with any claimant to obtain any other information needed to verify eligibility, or to issue a Bar Success Payment. Failure to do so will disqualify you from receipt of this award.
Upon confirmation of eligibility by the Company, a Bar Success Payment will be payable the following calendar month. Payment is expected to be made by electronic gift card (i.e., a prepaid payment card) delivered to the claimant’s validated email address; however, the Company, in its sole discretion may substitute another form of cash or cash equivalent of equal value (e.g., paper check) for any business reason.
The Company does not guarantee bar exam passage in connection with your use of Company products. Eligibility for a Bar Success Payment is not related to any exchange or services received from any bar exam taker or other person.
The Helix Guarantee
Bar Exam results, Bar Exam passage, or any other academic or professional results are not guaranteed by virtue of your purchase and/or use the Program. Notwithstanding, the Helix UBESM Guarantee and the Helix California Guarantee (either, the "Helix Guarantee") offers you one free repeat of the next administration of the bar review course for anyone using Helix for the first time and who completes at least 75% of the course (subject to the terms and conditions below). New books and other Program Materials are not included in the Helix Guarantee but can be purchased at cost, plus shipping for the then-current retail price, plus shipping and any applicable taxes.
You are entitled to a free repeat of the course purchased, if you meet all of the following criteria:
- You are a first-time user of the Program;
- You purchased the Program at least six (6) weeks prior to the Bar Exam date;
- You completed 75% of the Program prior to the Bar Exam date, including full completion of the following benchmark coursework:
- Three (out of four) MBE Practice Exams;
- The MBE portion of the Simulated Exam; and
- Submission of three (out of five) Graded Essays
- Failed the Bar Exam or provide evidence of registration for the Bar Exam and valid reason(s) for failure to sit for the exam;
- Use the free repeat for the next administration of the same jurisdiction's exam.
To claim the free course, you must notify us at [email protected] by providing your name and account email address. You must email a copy of your official bar exam results within 30 days of the date on the notice of failure. Failure to do so within 30 days waives your right to claim this Helix Guarantee. Once all information has been received and reviewed, the Company will determine your eligibility.
Students passing the bar after claiming the Helix Guarantee are not eligible to receive the Bar Success Payment.

You may not enroll in or use any Program Content for the benefit of any other entity or competitor of the Company or its affiliates. No portion of the Program Content may be shared, re-sold, reproduced, re-published, modified, transferred or distributed in any way without the Company's prior written permission. Choice of Law and Venue

By using the Program, should you have a dispute with the Company, you agree to submit to the exclusive jurisdiction of the state courts in Chester County, Pennsylvania or the federal court in the Eastern District of Pennsylvania and waive any jurisdictional, venue or inconvenient forum objections to such courts. In the event that any of these Terms and Conditions are held by a court or other tribunal of competent jurisdiction to be unenforceable, such provisions shall be limited or eliminated to the extent necessary so that these terms and conditions, and the content of our Privacy Policy, shall otherwise remain in full force and effect.
